- Heart rate
For certain portions of our Services relating to the Ambient Weather Network and/or Rainwise.net and Devices capable of reporting data to these Sites, the Services will also collect indoor weather and environmental sensor measurements including but not limited to temperature, humidity, pressure, air quality, moisture. Certain aspects of the Services may also access certain features of your mobile device, including its location services (GPS), and collect information from those features, such as your geographic location. You consent to this access. You may choose not to provide Personal Information or prevent the Services from accessing certain features of your mobile device (subject to the controls offered by your mobile device's operating system), but you understand that this may prevent you from receiving certain features of the Services.
We may offer you opportunities to engage in public activities on or through a Service. "Public activities" are any actions you take on or through a Service that are designed to be visible to third parties (including other users), including, without limitation, comments, recommendations, reviews, ratings, images, photos, videos, or any other content, information, or items that you submit. When you elect to connect our Services with, share or recommend links to, or share content on, any third-party service, software, or platform (including social media sites such as Facebook, Google+ and Twitter) (collectively, a "Third-Party Platform"), that action and any information you share will be governed by, and subject to, the third party's terms of service and privacy policy (or similar legal terms). Our Services may integrate with social media platforms, including Facebook and Twitter. When you connect a social media account to our Services, then we may collect information about that social media account and share information with that social media account as described in the connection process. How We Disclose Your Personal Information

We may also disclose, share or sell non-Personal Information specifically related to outdoor weather and environmental conditions collected by Ambient Weather Network and/or RainWise.net to business partners and third parties for weather and environmental related purposes such as forecasting, climate modeling and research. Lastly, we may also disclose non-Personal Information, aggregated with information about our other users, to our clients, business partners, merchants, advertisers, investors, potential buyers and other third parties if we deem such disclosure, in our sole discretion, to have sound business reasons or justifications.
Finally, we reserve the right to transfer information (including your Personal Information) to a third party in the event of a sale, merger, or transfer of all or substantially all of the assets of our company relating to the Services, or in the unlikely event of a bankruptcy, liquidation, or receivership of our business. We will use commercially reasonable efforts to notify you of such transfer, for example via email or by posting notice on our Site(s).
How We Protect Information
We take several measures intended to safeguard the collection, transmission and storage of the data we collect. Although we strive to employ reasonable protections for your information that are appropriate to its sensitivity, we do not guarantee or warrant the security of the information you share with us and we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content. Non-Personal Information Collected
We also collect non-Personal Information relating to the Services, that is, information that does not personally identify an individual. The non-Personal Information we collect includes how you interact with the Services, information generally collected or logged by Internet websites or Internet services when accessed or used by users, and information about your web browser or device accessing or using the Services.
Examples of the non-Personal Information we collect are:
- The pages of our Site that you viewed during a visit or the features of the App you use;

For certain portions of our Services relating to the Ambient Weather Network and/or Rainwise.net, the Services also collect data regarding outdoor weather and environmental sensor measurements including, but not limited to, temperature, humidity, pressure, rainfall, wind speed, wind direction, solar radiation, air quality, moisture. Data collected regarding outdoor weather and environmental sensor values with other identifying or geographic location information removed are considered non-Personal Information.
As discussed in more detail below, we sometimes use cookies and other automatic information gathering technologies to gather non-Personal Information. We will not use non-Personal Information to try to identify you, and if we associate any non-Personal Information with information that personally identifies you, then we will treat it as Personal Information. Additionally, we may transform your Personal Information into non-Personal Information (including, with respect to information regarding your geographic location, by generalizing (i.e. abstracting) that location so that it can no longer identify you).
Information collected by the Services may be collected by us or one of our Service Providers (as defined below) or Online Tool Providers.

For all people who have legal capacity to enter into an enforceable contract, we process data as necessary to perform our contracts with you. We describe the contractual services for which this data processing is necessary throughout this Privacy Policy and in our Terms of Service (the "Terms"). The main uses of your data necessary to provide our contractual services are:
- To provide, improve, customize, and support our Services (which may include disclosures to certain third parties who assist us with the foregoing activities);

US State Privacy Notices
California (CCPA)
This Privacy Notice for California Residents (the "Notice") supplements the information contained in our Privacy Policy and applies only if you reside in the State of California (you are a "California Consumer").
For purposes of this Notice "Sell", "Selling", "Sale", or "Sold", means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, Personal Information to another business or a third party for monetary or other valuable consideration.

- A consumer's account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;
- A consumer's precise geolocation;
- A consumer's racial or ethnic origin, religious or philosophical beliefs, or union membership;
- The contents of a consumer's mail, email, and text messages unless we are the intended recipient of the communication;
- A consumer's genetic or biometric data; or
- Personal Information collected and analyzed concerning a consumer's health, sex life, or sexual orientation.
"Verifiable Request" means that the identifying information provided by a consumer in connection with a request matches the personal information of the consumer already maintained by us or a third party identify verification service. Identifying information you can submit in order to permit us to verify your request may include your name, email address, and a secure confirmation code that we provide to you via email. Be aware that certain requests, such as requests for specific Personal Information or requests to delete Personal Information, may require us to be more selective about the types of identifying information required to fulfill your request. For example, we may require additional information to verify your identity if you submit a request to delete your Personal Information.
(1) Information We Collect
In the past twelve (12) months, NK has collected the following categories of Personal Information from California residents:
- Account identifiers (first and last name, age, email address, and phone number).
- Usage information (IP address, unique device identifiers, user experience recordings).
- Communications with our customer service department,
- Other information which is not required to use our Services but that you choose to provide to us on an online form, or messages that you send through the Services.
Additionally, in the past twelve (12) months, NK has collected the following categories of Sensitive Personal Information from California residents:
- Depending on which Services you use, we may collect information concerning your health;
- Depending on which Services you use, we may collect your geographic location
NK obtains this Personal Information directly from you. For example, from forms you complete or products and Services that you purchase and use.

NK may use or disclose the Personal Information we collect for one or more of the following "business purpose(s)":
- To fulfill or meet the reason you provided the information
- To provide our Sites, online services, Apps, and related Services

Lastly, to the extent that we create deidentified information based on your Personal Information, we hereby commit to maintain and use such deidentified information in deidentified form, and not to attempt to reidentify such information, except that we may reidentify such information solely for the purpose of determining whether our deidentification processes satisfy the requirements of the CCPA.
(3) Retention of Personal Information
We retain each category of your Personal Information for no longer than is reasonably necessary for one or more business purposes, subject to your right to request we delete your Personal Information. Due to the nature of the Services, it is not possible to predict the length of time that we intend to retain your Personal Information. We may disclose your Personal Information to the following categories of third parties: Service Providers, Online Tool Providers, and weather-related businesses and government agencies.
We “share” certain personal information with third party ad networks for purposes of behavioral advertising, including: Personal Identifiers, Internet Activity, and Commercial Information. This allows us to show you ads that are more relevant to you.

(5) Your Rights and Choices
If you are a California Consumer, you may request information about our collection, use, disclosure, and Sale of your Personal Information over the past twelve (12) months, whether or not it was collected electronically. If you submit a Verifiable Request, we will disclose:
- the categories of Personal Information we have collected about you; the categories of sources from which your Personal Information was collected; our business purpose for collecting, Selling, or Sharing your Personal Information; the categories of third parties with whom we disclose that Personal Information; and the specific pieces of Personal Information we collected about you; and
- if we Sold, Shared, or disclosed your Personal Information for a business purpose: what categories of Personal Information we Sold or Shared, and to which categories of recipients we Sold or Shared it to.
You also have the right to request that we delete any of your Personal Information that we collect or maintain by submitting a Verifiable Request. We may deny your deletion request if retaining your Personal Information is necessary for us or our Service Providers to:
- Complete the transaction for which we collected your Personal Information, provide goods or services that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;

- Exercise free speech, ensure the right of another consumer to exercise their right of free speech, or exercise another right provided for by law;
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the achievement of such research, if you previously provided informed consent;
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
- Comply with a legal obligation; or
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
You further have the right to request that we correct any of your Personal Information that is inaccurate by submitting a Verifiable Request. We will correct any inaccurate Personal Information according to your request to the extent possible using commercially reasonable efforts. We may deny your correction request if the Personal Information is accurate.
Lastly, you have the right to request that we limit the use and disclosure of Sensitive Personal Information by submitting a Verifiable Request. If you submit such a Verifiable Request, we may continue to use or disclose your Sensitive Personal Information to:
- Complete the transaction for which we collected your Personal Information, provide goods or services that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
- Use in a short-term and transient manner, including, but not limited to, to facilitate non-personalized advertising shown as part of your current interaction with the Services (but not including disclosure to third parties or use outside your current interaction with the Services);
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; or
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
If you choose to exercise a privacy right under the CCPA, you have the right not to receive discriminatory treatment.
You may submit a Verifiable Request for the information listed above, or exercise any of your rights enumerated under this Notice by completing the request form available here or by calling 1-800-784-4221 toll-free in North America or 1-610-447-1555. You may also submit a Verifiable Request on behalf of your minor child.
After we receive your Verifiable Request, we will provide to you, in writing and free of charge (unless your request is excessive, repetitive, or manifestly unfounded), the requested information for the 12-month period preceding your request. You can choose to have this information delivered to you by postal mail, electronically, or through your account. We will try to respond to your verified request within forty-five (45) days of receipt, but if we require more time (up to another forty-five (45) days) we will inform you of the reason and extension period in writing. Please note that we are not required to comply with your request for information more than twice in any 12-month period. If applicable, our response will explain the reasons why we cannot comply with your request.
NK does not and will not, without first obtaining your consent, Sell or Share Personal Information.

Consumers who sign up for our marketing emails/SMS texts may receive a discount on their first purchase. To opt in, a consumer must enter their email address/phone number into the form and consent to receive emails in exchange for a discount provided via coupon code. A consumer may unsubscribe from our marketing emails by using the unsubscribe link in the email footer/replying STOP via text at any time. We calculate the value of the offer and financial incentive by using the expense related to the offer.
California Shine the Light Disclosure
If you are a California resident and have an established business relationship with us, you can request a notice disclosing the categories of personal information we have shared with third parties, for the third parties' direct marketing purposes, during the preceding calendar year. Texas (TDPSA)
This Privacy Notice for Texas Residents (the "Notice") supplements the information contained in our Privacy Policy and applies only if you reside in the State of Texas (a resident of Texas a "Texas Consumer"). The Notice applies equally to Texas Consumers unless noted otherwise.
For purposes of this Notice "Sell," "Selling," "Sale," or "Sold," means the exchange of Personal Information for monetary or other valuable consideration by NK to a third party. "Sell," "Selling," "Sale," or "Sold," does not include the following:
- Disclosure of Personal Information to a third party that processes data on behalf of NK;
- Disclosure of Personal Information to a third party for purposes of providing a product or service requested by you;
- Disclosure or transfer of Personal Information to an affiliate of NK;
- Disclosure or transfer of Personal Information to a third party as an asset that is part of a proposed or actual merger, acquisition, bankruptcy, or other transaction in which the third party assumes control of all or part of NK's assets; and

"Sensitive Personal Information" means any of the following: (1) Personal Information revealing racial or ethnic origin, religious beliefs, a mental or physical health diagnosis, sexuality, or citizenship or immigration status; (2) genetic or biometric data that is processed for the purpose of uniquely identifying an individual; (3) Personal Information collected from a known child younger than 13; or (4) precise geolocation data (which means information that identifies the specific location of an individual with precision and accuracy within a radius of 1,750 feet).
"Verifiable Request" means the identifying information provided by a consumer in connection with a request matches the Personal Information of the consumer already maintained by us or a third party identity verification service. Identifying information you can submit in order to permit us to verify your request may include your name, email address, and a secure confirmation code that we provide to you via email. Be aware that certain requests, such as requests for specific Personal Information or requests to delete Personal Information, may require us to be more selective about the types of identifying information required to fulfill your request. For example, we may require additional information to verify your identity if you submit a request to delete your Personal Information.
"Targeted Advertising" means displaying to a consumer an advertisement that is selected based on Personal Information obtained from that consumer's activities over time and across nonaffiliated websites or online applications to predict the consumer preferences or interests. "Targeted Advertising" does not include the following:
- Advertising to a consumer in response to a consumer request for information or feedback;
- Advertisements based on activities within our own websites or online applications;
- Advertisements based on the context of a consumer's current search query, visit to a website, or online application; or
- Processing Personal Information solely for measuring or reporting advertising performance, reach, or frequency.

NK obtains this Personal Information directly from you. For example, from forms you complete or products and Services that you purchase and use.
By accessing or using the Services, you consent to the collection and processing of Sensitive Personal Information in the categories listed above. If you do not consent to the collection and processing of Sensitive Personal Information within these categories, please do not access or use the Services.
2. Use of Personal Information
NK may use or disclose the Personal Information we collect for one or more of the following "business purpose(s):"
- To fulfill or meet the reason you provided the information;
- To provide our Sites, online services, Apps, and related Services;
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations;
- To respond to your requests under Relevant Data Privacy Law;
- For any other purpose described to you when we collect your Personal Information; and
- For any other acceptable purposes as set forth in the Relevant Data Privacy Law
Unless we notify you otherwise, we will not collect additional categories of Personal Information, nor use the Personal Information we collect for any other materially different, unrelated, or incompatible purposes.
Lastly, to the extent that we create deidentified information based on your Personal Information, we hereby commit to maintain and use such deidentified information in deidentified form, and not to attempt to reidentify such information.
3. Disclosures of Personal Information
NK has disclosed your Personal Information as described in this Notice.
NK discloses Personal Information to third parties for a business purpose. When we disclose Personal Information for a business purpose, we enter into an agreement with the receiving party that describes the purpose for sharing the Personal Information, and that requires the receiving party to keep that Personal Information confidential.
We may disclose your Personal Information with the following categories of third parties: Service Providers, Online Tool Providers, and weather-related businesses and government agencies.
We process personal data for purposes of targeted advertising (as defined in the TDPSA), including: Personal Identifiers, Internet Activity, and Commercial Information. This allows us to show you ads that are more relevant to you.

We do not receive monetary or other valuable consideration in exchange for your data and therefore do not "sell" your data as defined in TDPSA.
4. Your Rights and Choices
If you are a Texas Consumer, you may request information about our collection and processing of your Personal Information, whether or not it was collected electronically. If you submit a Verifiable Request, we will disclose whether we have collected or processed your Personal Information and allow you to access the Personal Information we have collected, to the extent we continue to retain the Personal Information. To the extent technically feasible, we will disclose this information to you in a readily usable format that allows you to transmit the data to another entity without hindrance. In the event that you make more than (2) requests in any twelve (12) month period, we reserve the right to charge a fee prior to processing any such request(s).
You also have the right to request that we delete any of your Personal Information that we collect or maintain by submitting a Verifiable Request. We may deny your deletion request if retaining your Personal Information is necessary for us or our Service Providers to:
- Complete the transaction for which we collected your Personal Information, provide goods or services that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
- Prevent or detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or investigate, report, or prosecute those responsible for such activity;
- Debug products to identify and repair errors that impair existing intended functionality;
- Engage in public or peer-reviewed scientific or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the achievement of such research, if you previously provided informed consent;
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
- Cooperate with law enforcement agencies concerning conduct or activities that we reasonably and in good faith believe may violate the law;
- Comply with a legal obligation; or
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
If you are a Texas Consumer, you further have the right to request that we correct any of your Personal Information that is inaccurate by submitting a Verifiable Request. We will correct any inaccurate Personal Information pursuant to your request, taking into account the nature of the Personal Information and the purposes of the processing of your Personal Information. We may deny your correction request if the Personal Information is accurate.
If you choose to exercise a privacy right under the Relevant Data Privacy Law, you have the right not to receive unlawful discriminatory treatment.
You may submit a Verifiable Request for the information listed above, or exercise any of your rights enumerated under this Notice by completing the request form available here or by calling 1-800-784-4221 toll-free in North America or 1-610-447-1555. You may also submit a Verifiable Request on behalf of your minor child who is under 13 years of age.
After we receive your Verifiable Request, we will provide to you, in writing, the requested information. You can choose to have this information delivered to you by postal mail, electronically, or through your account. We will try to respond to your verified request within forty-five (45) days of receipt, but if we require more time (up to another forty-five (45) days) will inform you of the reason and extension period in writing. If we decline to act on your request for any reason permitted under the Relevant Data Privacy Law, we will notify you of our decision within forty-five (45) day of receiving your request. If applicable, our response will explain the reasons why we cannot comply with your request.
If we deny your request or fail to act on it within the required time period, you may have the right to appeal this decision by submitting a new Verifiable Request in which you conspicuously note that you are appealing a previous decision. We will respond to your verified request to appeal within sixty (60) days of receipt. If applicable, our response will explain the reasons why we are denying your appeal, and any further steps that may be available to you.

- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, please be aware that it may be a functional necessity for our Services to have Personal Information about you in order to operate, and we may not be able to provide some or all of our Services to you if you direct us to delete your Personal Information
